DEFENDANT'S INITIAL DISCLOSURES PURSUANT

TO FEDERAL RULE OF CIVIL PROCEDURE 26(a)(l)

Defendant and Plaintiff-in-Counterclaim Wolfe's Borough Coffee, Inc. ("Wolfe's

Borough") hereby submits its initial disclosures in accordance with Rule 26(a)(l) of the Federal

Rules of Civil Procedure. Wolfe's Borough reserves the right to supplement and/or amend these

disclosures as appropriate during the course of this action.

Rule 26(a)(1)(C)

Wolfe's Borough claims damages for loss of business due to Starbucks' actions, damage to its reputation and trademarks, and expenses incurred by it, including attorneys' fees and costs, as a result of Starbucks' prosecution of this action. Wolfe's Borough further seeks multiple damages and punitive damages. A computation of such damages is not available at this time;

Wolfe's Borough agrees to supplement this response in a timely manner.

Rule 26(a)(1)(D)

        Wolfe's Borough will provide Starbucks with a copy of the following insurance agreement: Zurich American Insurance Group, No. PAS30929054.
