PLEASE TAKE NOTICE that upon the annexed Declaration of John C. Rawls,
dated March 27, 2002, the accompanying memorandum of law, and upon all prior pleadings and
proceedings herein. Plaintiffs Starbucks Corporation and Starbucks U.S. Brands Corporation
(named herein as "Starbucks U.S. Brands, Inc.") ("Plaintiffs"), will move this Court, on a dated
to be set by the Court, before the Honorable Loretta Swain, United States District Court Judge,
Southern District of New York, at the United States Courthouse, 500 Pearl Street, New York,
New York, 10007, for an order:
1. Granting Plaintiffs leave to file a First Amended Complaint in this matter;
and
2. Granting Plaintiffs such other and further relief as the Court deems just
and reasonable.
PLEASE TAKE FURTHER NOTICE that in accordance with Rule 6.1(b) of
the Rules of the United States District Courts for the Southern and Eastern Districts of New
York, any opposing affidavit^ and answering memoranda shall be served within ten (10) business
days after service of this motion, and any reply affidavits and memorandum shall be served
within five (5) business days after service of the answering papers.
